These Terms of Use ("Terms") govern your access to and use of fairway.cam and the public golf course information, maps, search, Nearby results, and related features made available through the website (collectively, "Fairway"). Fairway is operated by Fairway.cam LLC ("we," "us," or "our").

By accessing or using Fairway, you agree to these Terms and our Privacy Policy. If you do not agree, do not use Fairway. These Terms apply to the public website and do not govern a separately distributed Fairway application unless that application expressly refers to them.

1. What Fairway provides

Fairway helps golfers discover courses and view information such as addresses, contact details, scorecards, tee yardages, par, course ratings, slope ratings, facility access, amenities, hole previews, maps, nearby distances, weather, and links to course or booking websites. Fairway is an informational service. It is not a golf course operator, surveying service, emergency service, transportation provider, or booking agent unless we expressly say otherwise.

2. Course information and maps

Course information can change and may be incomplete, approximate, or out of date. This includes addresses, phone numbers, websites, booking availability, access policies, amenities, scorecards, yardages, par, ratings, slopes, tee information, and course layouts. Confirm information that matters to your visit or round directly with the golf course.

Fairway's maps and hole previews are independently produced from publicly available course information, imagery, and Fairway's own coordinate-generation and review work. They are practical visual references, not official surveys, property records, club-operated maps, or guarantees of current playing conditions. Tee positions, green locations, hazards, boundaries, cart routes, and playable areas may differ from what appears on Fairway.

3. Safety and on-course use

Use your own judgment and follow posted signs, course rules, staff instructions, local laws, and actual conditions. Do not use Fairway in a way that distracts you while driving a vehicle or golf cart, and do not rely on Fairway to identify property boundaries, restricted areas, dangerous conditions, evacuation routes, or emergency hazards.

4. Nearby results, location, and directions

Nearby results and mileage estimates depend on the coordinates and accuracy reported by your device. They are estimates and may not reflect road distance, travel time, entrances, closures, or actual conditions. Location permission is optional. How Fairway handles location information is described in our Privacy Policy.

Direction links open Google Maps. Your use of Google Maps is governed by Google's Google Maps Additional Terms and Privacy Policy. Fairway does not control Google's routes, content, availability, or handling of information sent when you open Google Maps.

5. Weather information

Weather information is provided for convenience and may be delayed, incomplete, or inaccurate. Do not rely on Fairway for emergency, severe-weather, or personal-safety decisions. Consult official local alerts and the National Weather Service when weather conditions matter.

6. Booking and third-party services

Course websites, booking buttons, direction links, and other external links take you to services operated by third parties. Unless Fairway expressly states otherwise, Fairway is not the seller, booking agent, or party to any transaction you make with a course or booking provider. We do not control and are not responsible for tee-time inventory, prices, fees, payment processing, cancellations, refunds, course policies, third-party content, or the availability or security of an external service.

A link does not mean that Fairway endorses or guarantees the linked service. Your dealings with a third party are between you and that third party and are governed by its terms and policies.

7. Course names and affiliation

Fairway is not affiliated with, endorsed by, sponsored by, or acting for a listed golf course, governing body, booking provider, or other third party unless we expressly identify that relationship. Course names, logos, trademarks, and other third-party marks belong to their respective owners and are used for identification.

8. Fairway content and permitted use

Fairway's original maps, hole previews, imagery derivatives, software, design, text, graphics, and selection and arrangement of content are owned by Fairway.cam LLC or its licensors and are protected by applicable law. Nothing in these Terms claims ownership of underlying public facts or third-party materials.

We grant you a limited, revocable, nonexclusive, nontransferable license to access and use Fairway for personal, lawful, noncommercial purposes. Except as allowed by law or with our written permission, you may not reproduce, sell, license, republish, create a competing dataset from, or commercially exploit a substantial part of Fairway or its original maps and content.

9. Acceptable use

You may not:

• use Fairway for an unlawful, fraudulent, or harmful purpose;
• interfere with the operation or security of Fairway;
• attempt unauthorized access to systems, data, or accounts;
• bypass technical controls, rate limits, or access restrictions;
• introduce malware or conduct abusive or disruptive automated requests;
• scrape or extract Fairway content in bulk, except for ordinary search-engine indexing that follows our published crawler instructions; or
• misrepresent your affiliation with Fairway or any listed course.

10. Corrections and feedback

If you submit a correction, suggestion, or other feedback, you grant Fairway a worldwide, perpetual, irrevocable, royalty-free license to use, reproduce, modify, and incorporate it into Fairway without obligation or compensation. Do not submit confidential information or material that you do not have the right to provide.

11. Availability and changes

We may add, change, suspend, or discontinue any part of Fairway at any time. We do not promise that Fairway will always be available, uninterrupted, secure, or error-free, or that every course or feature will remain available.

12. Disclaimer of warranties

To the fullest extent permitted by law, Fairway is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory. Fairway.cam LLC disclaims implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement, and any warranty arising from a course of dealing or usage of trade. Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you.

13. Limitation of liability

To the fullest extent permitted by law, Fairway.cam LLC and its members, officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, use, or other intangible losses arising from or relating to Fairway, third-party services, course information, maps, directions, weather, or your visit to or use of a golf course.

To the fullest extent permitted by law, the total liability of Fairway.cam LLC for all claims arising from or relating to Fairway will not exceed the greater of $100 or the amount you paid directly to Fairway for the website during the 12 months before the event giving rise to the claim. Nothing in these Terms excludes liability or consumer rights that cannot lawfully be excluded or limited.

14. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Fairway.cam LLC and its members, officers, employees, and contractors from third-party claims, liabilities, damages, and reasonable expenses arising from your unlawful misuse of Fairway or your material violation of these Terms.

15. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute arising from these Terms or Fairway must be brought in a state or federal court in California that has jurisdiction over the dispute, and each party consents to the jurisdiction of those courts. This section does not limit rights you may have under mandatory laws that apply where you live.

16. General terms

These Terms and the Privacy Policy are the entire agreement between you and Fairway.cam LLC regarding the public website. If a provision is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign your rights under these Terms without our consent; we may assign these Terms in connection with a reorganization, merger, acquisition, or sale of assets.

17. Changes to these Terms

We may update these Terms as Fairway evolves. The updated Terms will be posted on this page with a revised date. Changes apply from the stated effective date. Your continued use of Fairway after that date means you accept the updated Terms.
